Headings are for reference purposes only and in no way define, limit, interpret or describe the scope or extent of this section. No delay by a person/persons in enforcing any provision of this Viewer Agreement or any right herein shall be interpreted as a waiver of such provision or right, and no waiver of any provision or right on any occasion or with respect to any breach shall be interpreted as a waiver of such provision or right on any other occasion or with respect to any other breach. No party may assign this Viewer Agreement in connection with a sale, service or all of the assets or equity to which this Viewer Agreement relates without the express written consent of HearSee . Any attempt to assign this Viewer Agreement shall be null, unless expressly permitted herein. This Viewer Agreement shall be binding on, and inure to the benefit of, a person/persons permitted successors and assigns. Neither person/persons shall be deemed in default hereunder, nor shall it hold the other person/persons responsible for, any cessation, delay or interruption in the performance of its obligations hereunder due to causes beyond its reasonable control including, but not limited to: earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict or the inability to obtain sufficient material, supplies, labor, transportation, power or other essential commodity or service required in the conduct of its business, including Internet access, or any change in or the adoption of any law, ordinance, rule, regulation, order, judgment or decree. This Viewer Agreement sets forth the entire understanding and agreement between you and HearSee with respect to the subject matter hereof, and supersedes any prior or contemporaneous understanding, representation, or agreement. HearSee retains all rights, title and interest in and to this web-site and services provided hereunder.

Policies:
Any claim or controversy developed out of or relating to this Viewer Agreement or HearSee (10.SERVICES) shall be settled by binding arbitration in accordance with the applicable rules of the American Arbitration Association or necessary Arbitration Association. Any such claim or controversy shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in accordance to CRTC and FCC regulations as well as the Telecommunications Act, and judgment on the arbitration award may be entered into any court having jurisdiction over a party. HearSee may seek an injunction or any interim or preliminary relief from a court of competent jurisdiction necessary to protect associates and all the employees of HearSee rights or property pending the completion of arbitration.

HearSee employees are or were members/students of reputable education facilities and/or hold certifications and/or degrees in field positions.

Privacy:
HearSee holds all client information in the strictest of confidentiality.
Procedures:
Hosting and registration requires user name and password.
Regulations:
All activity conducted by HearSee must be authorized by the president of HearSee to be legitimate .
Restrictions:
HearSee and/or affiliates reserve the right to discontinue business, guarantees and service(s) with any client(s) without warning due to illegal activity performed with equipment or by client(s). HearSee reserves the right to revoke any client(s) without given reason due to any irregular activity thought to occur via prospective client(s).

Terms:
